TERMS AND CONDITIONS FOR PURCHASES FROM OUR ONLINE STORE

In effect from 1.11.2016.

1. General issues

These terms and conditions apply to transactions between Fanimo Oy (hereafter "Fanimo") and its customers. Fanimo reserves the right to update these terms and conditions without prior notice. The terms and conditions applying to any order will be those in effect at the time the order is placed, as presented on the online store’s website.
In addition to these terms and conditions, transactions through the online store are also covered by the general terms and conditions applying to use of the online services of the Football Association of Finland (FAF). All users of FAF’s online services make a commitment to observe the terms and conditions currently in effect. These services include all of the online services produced or maintained by the FAF, such as the online store at www.kauppa.palloliitto.fi.

3. Registration and transactions with the online store

Official merchandise related to Finland’s national football teams is sold by Fanimo. We sell products to adults (aged 18 or over) resident in Finland or abroad, who have valid e-mail addresses. Product prices include value added tax (ALV). We reserve the right to change product prices and postal charges.

It is not necessary to become a registered customer to place an order with the online store. Any customer ordering products without registering should provide the details specified as compulsory together with each individual order. These terms and conditions apply to transactions involving both registered and unregistered users.

Customers should provide accurate personal details in all dealings with the online store, including customer registration. Customers are responsible for the accuracy of the information they provide, and Fanimo should be informed of any changes in these details without delay.

Customers may register with our online store if they wish, to make future transactions faster and easier. Registered customers may review all their previous orders through the "My orders" section of the online store. Registration is free. When registering with the store customers use their personal e-mail addresses as their username. After registering, newly registered customers receive an email with a link enabling them to set their own password. Customers are responsible for keeping their password secure, and for all transactions subsequently conducted with the online store under their username. Customers should contact our customer services immediately if they realise or suspect that their username and password have been revealed or are being misused. Fanimo reserves the right to discontinue usernames and passwords temporarily or permanently.

4. Ordering products

Products are mainly ordered via the internet using the shopping basket section of the online store at www.palloliitto.fi/kauppa.

Customers place orders by selecting products from the online store’s product range. The selected products are added to the customer’s shopping basket, where customers must choose the quantities of each product that they wish to order (default = 1). Products may be removed from the customer’s shopping basket before any order is confirmed and paid for. The online store automatically checks the availability of the products to be ordered whenever the customer visits the shopping basket page. The availability of products visible in the shopping basket may still change before payment is completed.

Customers commit themselves to pay for the purchased products when they submit their order to the online store (see section 10, “Right of cancellation”). Customers are encouraged to check the details of their orders carefully before confirming them. Customers must understand and accept that orders are linked to payment obligations.

All orders are subject to confirmation by e-mail, through "order confirmation" e-mails, which specify:

  • the order number
  • the customer’s details
  • the payment method
  • the total payment sum
  • the products ordered
  • delivery details and related charges
  • the proportion of the sum consisting of value added tax (ALV)

To receive an order confirmation customers must provide their e-mail address when placing an order. Customers are responsible for checking that the details in the order confirmation match the order they placed.

Fanimo reserves the right to refuse to fulfil individual orders. This may be necessary if, for instance, the product ordered or a suitably similar product is no longer available.  
Customers are obliged to observe the currently valid terms and conditions in connection with each order.

5.  Prices

Products’ prices remain in effect until further notice, or for specified periods. Charges will be made in accordance with the prices in effect at the time of ordering, as specified in the order confirmation. If the online store has received an incorrect price, this price will not be considered binding by Fanimo if the customer knew or should have known that the price was incorrect.

Prices are specified in euros (EUR), including value added tax (ALV). Products’ prices do not include delivery and handling charges, which are separately specified immediately when an order is placed and in the order confirmation sent to the customer.

The delivery charges for products are specified separately together with the product details in the online store. If a customer orders several products with different delivery charges, the delivery charge will correspond to the highest of these charges. Delivery charges vary within the range of €1.90 – 29.50 (including value added tax) depending on the delivery method chosen. Only one delivery charge will be made for each order.

6. Payment methods

Payment must be made for products and postal expenses at the same time the order is placed.  Payment may be made through the following banks: Nordea, Osuuspankki, Danske Bank, LähiTapiola, Aktia, Nooa, Paikallisosuuspankit, Säästöpankit, Handelsbanken, S-Pankki, Ålandsbanken; by credit or debit card; or through the Collector invoicing and part payment scheme. Payments are made through the website of Paytrail Oyj.

Payment is made at the end of the ordering process. After the payment method is approved, the customer’s order goes on from the online store to Fanimo’s handling and delivery stage.

Payment service provider

Payment transactions and services are provided by Paytrail Oyj (Business ID: 2122839-7) in collaboration with Finnish banks and credit institutions. Paytrail Oyj will be specified as the payment recipient in customers’ bank account statements or payment card invoices, and Paytrail Oyj will transfer the payment onward to the online store. Paytrail Oyj is officially licensed to operate as a payment service provider. Complaints related to payment processes should initially be directed to the product provider.

Online banking services

Transaction services related to payments made through online banking services are provided by Paytrail Oyj (Business ID: 2122839-7) in collaboration with Finnish banks and credit institutions. From the customer’s perspective the service works exactly like conventional online payment services.

Collector Bank’s invoicing and part payment services

Customers can use Collector Bank’s invoicing and part payment services for purchases not exceeding €5000. Collector Bank’s invoicing service has an interest-free* payment period of at least 30 days and sometimes as long as 60 days.

Payment only needs to be completed on the final day of the next full calendar month after the actual date of purchase. (* the interest rate is 0% during the payment period, but an invoicing fee of €2.95 is added to the first invoice)

The total sum of an invoice may be paid on the due date, or customers may also choose to pay in instalments over a period of 1-36 months. This part payment system is initiated instantly when the minimum part payment sum marked on the invoice has been paid. Customers may also choose to make payments in larger instalments, or make the whole payment at once.

The interest rate charged through the part payment scheme is 1.6% per month, which amounts to a nominal annual interest rate of 19.2%. A monthly account management fee of €2.95 is added to each payment invoice, bringing the annual interest rate for purchases amounting to €1000 up to 21.3%.

Collector Bank’s invoicing and part payment service may be used by anyone over 20 years of age who has a clean credit history. Collector Bank AB checks the credit records of in connection with each order. For late payments and unpaid invoices Collector Bank AB charges a fee of €5 for each reminder sent, as well as interest at a monthly rate of 1.6% for the period of delay.

7. Availability of products

Fanimo strives to ensure that the online store has accurate and up-to-date information on the availability of products, but we cannot guarantee the absolute accuracy of this information with regard to the availability of sufficient purchasable products. Certain products are only produced in limited quantities, or may be temporarily sold out or otherwise unavailable.

If it becomes apparent after an order is received that an ordered product is temporarily or permanently unavailable, even though the system enabled the order, Fanimo will inform the customer immediately using the contact details provided by the customer with the order.

If an ordered product is completely unavailable, Fanimo is committed to repay to the customer in full the price already paid for the product, and the purchase of the product in question will be considered as cancelled. In such cases Fanimo’s customer services contact the customer, who may if they wish keep the purchase valid and approve a longer delivery time or the delivery of another product in place of the unavailable product.

8. Product deliveries

Products can generally be delivered to addresses in Finland within 2-4 working days. We strive to deliver national team shirts with personalisation within 7-10 working days. If we cannot deliver a product within this time frame, we contact the customer by e-mail or telephone.

Customers may be informed separately about any exceptional delivery times.

If a customer does not collect a delivered product from the post office of their choice within the specified collection period, Fanimo reserves the right to charge additional delivery costs to the customer for any subsequent redelivery of the product.

Delivery charges and methods

Delivery charges include the costs of postage and packaging. Details of the online store’s delivery methods and charges are available here.
Parcel orders can be followed online using the delivery code. Fanimo cannot compensate customers in cases where the postal services lose products ordered for delivery in letter form.

9. Conditions for returning or exchanging products

Finnish consumer protection laws give customers the right to return or exchange unwanted products within 14 days of the date when the customer receives the products ordered. These rights only apply to unused products that can be resold as new. National team shirts with personalisation are not covered by these rights.

The refund will be paid to the customer when we have received and examined the returned product. When the product return has been approved, customers will receive instructions for accepting the refund from Paytrail.

We will not accept products returned more than 14 days after the initial delivery. The postal charges for the initial order will not be refunded.

Exchanging or returning products

Fanimo Oy has an ongoing agreement with the Finnish postal service covering product returns. We do not use a “cash on delivery” system for product returns. Products may be returned by customers free of charge.

Enclose in the package the product exchange and return form that you received with the product. Fill in the form, giving details of the products that you wish to return or exchange. If you wish to exchange a product, specify on the form which product and size you wish to receive in exchange. Make sure that you enclose the completed form in the package.

Products may be returned in their original delivery package if they are well packed. They must be unused and in suitable condition for resale, with any labels etc. duly replaced in the original package. DVDs must be unopened. National team shirts with personalisation are not returnable or exchangeable.

Transport problems and damaged or defective products

On receiving delivered products customers should immediately check that the products are intact and have no defects. They should also ensure that delivery packages contain all of the products they ordered.

It is worth checking the delivered goods in the presence of postal staff. If a product has been damaged during transportation, the customer should immediately register a complaint with the post office, and then also contact Fanimo as described below.

If a customer notices that a delivery or delivered products are otherwise defective, they should inform Fanimo’s customer services without undue delay, and at the latest within 14 days, by telephone (+358 (0)9 742 151), by e-mail (kauppa@palloliitto.fi), or by post (Fanimo Oy, PO box 191, 00251 Helsinki, Finland).

After inspecting and confirming any defects in deliveries or products, Fanimo has the right in the first instance to remedy the defect or deliver an undamaged replacement product within a reasonable time frame. Fanimo takes responsibility for defective goods in accordance with Finnish consumer protection legislation, either alone, or together with the manufacturer or importer of the product.

10. Right of cancellation

When ordering products from the online store of Finland’s national football team you have a statutory right of cancellation (under Finland’s Consumer Protection Act 38/1978, chapter 6, section 9, sub-section 3). This right expires 14 days after products are received.

To realise this right of cancellation customers should inform Fanimo’s customer services of their decision to cancel the purchase by telephone (+358 (0)9 742 151), e-mail (kauppa@palloliitto.fi) or post (Fanimo Oy, PO box 191, 00251 Helsinki, Finland). After receiving products, customers should keep them in unused condition until they decide whether they wish to keep them. If a returned product has been used contrary to the legal obligations imposed on buyers to take good care of any products to be returned, Fanimo reserves the right to deduct any consequent loss in the value of the product, up to the product’s total price.

Customers do not, however, have any right to cancel purchases of “tailored products”, i.e. products that have been manufactured or altered according to the customer’s personal needs or wishes. This exception includes national team shirts with personalisation, for instance.

Customers may return the products they ordered together with the product exchange and return form that they received with the original order. Alternatively they may use the cancellation form below (in Finnish only), though its use is not compulsory.

With regard to the deadline for using cancellation rights, it is sufficient for customers to inform the seller before their right of cancellation expires that they intend to make use of it.

11. Cookies

The Palloliitto.fi website uses cookies to make the site even more user friendly, to save users time, and to enhance user experience. Cookies can also be used to provide customers with enhanced offers and more personally targeted product recommendations. Cookies are small text files that the website’s server stores on users’ hard disks. Some parts of the website content will only function if users accept cookies. Users’ browsers will probably accept cookies by default, but users can also prevent the use of cookies by changing the settings on their browser or by removing cookies from the browser after using the service. 12. Use of personal data

The Football Association of Finland (FAF) and Fanimo Oy use personal data provided by registered users in accordance with FAF’s data privacy policy and legislation protecting privacy. For more information on how personal data is used see FAF’s data privacy policy.

13. Problems due to external factors beyond our control

Fanimo will not take responsibility for any damage or defects in products, any delivery delays, or any other contractual infringements that are the result of an external factor beyond our control (force majeure). In such eventualities Fanimo will nevertheless strive to serve customers as well as possible.

14. Changes to terms and conditions

We reserve the right to change our delivery terms and conditions. Before placing an order customers should review the conditions currently in force. If customers continue to conduct transactions in our online store after terms and conditions are changed, this will be considered to signify their approval of any changes made in the terms and conditions.

15. Resolving disputes

If a dispute concerning a transaction cannot be resolved through discussions between the parties involved, consumers may seek resolution of the issue through the Consumer Disputes Board (www.kuluttajariita.fi). Before taking any case to the Consumer Disputes Board, consumers should first contact the Finnish Competition and Consumer Authority (www.kuluttajaneuvonta.fi).
